General Terms and Conditions of Use 

1. LEGAL MENTIONS 

The website www.dih.lu (the “Website”) is administered by Luxinnovation GIE on behalf of the Consortium Luxembourg Digital Innovation Hub (hereinafter, ‘the Consortium’ or ‘the L-DIH Consortium’ or ‘We’). Luxinnovation is responsible for the design, graphic creation, development and technical monitoring of the Site.

 The main aim of the Luxembourg Digital Innovation Hub (L-DIH) consortium is to support the digital transformation of Luxembourg businesses, particularly in the manufacturing sector, towards Industry 4.0. It also aims to foster the development of the country's digital ecosystem and strengthen cross-border cooperation in the field of digitisation.

 In Luxembourg, the L-DIH Consortium is the result of a strategic partnership between the following entities : 

  • Chamber of Commerce (strategic partner): 7, rue Alcide de Gasperi L-1615 Luxembourg, registered J41 with the RCSL; 
  • Competence center - Université de Luxembourg: 2, place de l'Université L-4365 Esch-sur-Alzette, registered C145 with the RCSL; 
  • FEDIL (strategic partner): 7, rue Alcide de Gasperi L-1615 Luxembourg, RCSL registration number F6043;
  • Fonds national de la Recherche (strategic partner and financial support): 2, place de l'Université L-4365 Esch-sur-Alzette, registered J40 with the RCSL; 
  • Luxembourg House of Cybersecurity: 122, rue Adolfe Fischer L-1521 Luxembourg, registered C90 with the RCSL; 
  • Luxinnovation GIE (Coordinator): 5, avenue des Hauts Fourneaux L-4362 Esch-sur-Alzette, registered C16 with the RCSL;
  • Luxembourg Institute of Science and Technology (LIST): 5, avenue des Hauts Fourneaux L-4362 Esch-sur-Alzette, registered J53 with the RCSL;

The Consortium is responsible for the content of the Site. Luxinnovation is responsible for its design, graphic creation, development and technical monitoring.

 The Site is published by Inwink, a simplified joint stock company with registered offices at 33, rue du Faubourg Saint Antoine F-75011 PARIS, registered with the Paris Trade and Companies Register under number 521 915 637.

The host is Microsoft Ireland Operations via its Azure cloud services offering, headquartered at Carmanhall Road - Sandyford Business Estate - Dublin 18 - Ireland

Any User browsing and consulting the Site is deemed to have read and accepted all of the following terms and conditions (T&C). 


2. DEFINITIONS 

Applicable laws”: means all laws, regulations and other requirements applicable in the Grand Duchy of Luxembourg, as amended;; 

Consortium”: refers to the group formed by the association of entities (LuxProvide, Luxinnovation, LIST, PNED/LNDS, University of Luxembourg) united to create a robust and interconnected network of artificial intelligence (AI) hubs, acting as a one-stop shop. The Consortium is considered a legal entity in its own right for the purposes of the Site;  

Intellectual Property Rights: means, without limitation and where applicable, all present and future patents, utility models, ideas and rights to inventions (whether or not patentable or reduced to practice), improvements, all copyright and neighbouring rights (including without limitation moral rights, as well as the rights of reproduction, distribution, communication to the public, renting and lending), trademarks (whether registered and unregistered), service marks, rights in designs or models (whether registered or unregistered), brand names, product names, logos, slogans, trade names, company names and reputation, domain names, database right, rights in confidential and/or proprietary information (including without limitation know-how and trade secrets), rights in software (including without limitation algorithms, application programming interfaces, source, executable and object code, apparatus, circuit designs and assemblies), network configurations and architectures, concepts, marketing and development plans, methods and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world; 

User Data: Refers to all data, documents, content or information submitted by the User when using the Platform, by the Account Holder when creating an Account, including, but not limited to, commercial data relating to a Legal Entity or personal data provided by the Member of an Online Community;  

Intellectual property rights”: Refers, without limitation and where applicable, to all patents, utility models, ideas and rights to inventions (whether or not patentable or reduced to practice), improvements, all copyrights and related rights (including, without limitation, rights of reproduction, distribution, communication to the public, rental and lending), trademarks (registered or unregistered), service marks, design rights (registered or unregistered), brand names, product names, logos, slogans, trade names, company names and reputations, domain names, database rights, rights in confidential and/or proprietary information (including, without limitation, know-how and trade secrets), software rights (including, without limitation, algorithms, interface application programming, source, executable and object code, devices, circuit designs and assemblies), network configurations and architectures, concepts, marketing and development plans, methods and any other intellectual property rights, in each case, whether registered or unregistered and including all applications for and renewals or extensions of such rights, and any similar or equivalent rights or forms of protection in any part of the world. 

Parties": means the Consortium and the User;

“ Personal data” : means any data relating to a natural person who can be identified directly or indirectly, by means of identification (name, job title, company or organization of affiliation, etc.) or contact details (e-mail address, among others);

Services: means all services provided on the Website; 

Users: refers to any natural or legal person who consults the information on the Site and requests the services made available; 

Website”: refers to the Site where the content, information and services made available by the Consortium can be consulted, in the form of texts, images, videos, contact forms, legal notices, General Conditions of Use, Privacy Notice and other associated rights.


3. SUBJECT  

The purpose of these Terms and Conditions is to define the terms and conditions under which Users (‘the User’ or ‘You’) may access and use the Site. These CGTU are a tool made available free of charge and securely, in accordance with the best practices applicable to technologies specific to websites.


4. LINK TO THIRD-PARTIES WEBSITES

For the convenience of Users, the Site may contain links to third-party websites whose mention is deemed useful and/or relevant by the Consortium. The content of these sites is not checked prior to their inclusion on the Site. The Consortium cannot be held responsible for their operation, accessibility, the accuracy of the information presented, the legality and authenticity of the third-party sites to which they in turn refer, or for any direct or indirect damage they may cause.


5. OBLIGATION OF THE USER

Access to the Website is via Internet, User declares to know the risks and to accept them. He must protect himself against the effects of computer piracy by adopting an appropriate and secure computer configuration.

The members of the Consortium may not be held liable for any damage that the User may suffer directly or indirectly as a result of browsing this site and using its services or the websites to which it refers.

The User undertakes to act sincerely and fairly, in accordance with these GCU. 

The User undertakes not to send any messages via the contact form whose content is contrary to Luxembourg and European legislation and regulations, and/or of a defamatory, discriminatory or prejudicial nature on any grounds whatsoever. 

The User is warned that the Consortium is free to take legal action in the event of flagrant contravention of these GCU.


6. INTELLECTUAL PROPERTY

The Consortium enjoys full ownership of this Site (architecture, texts, titles, photography, graphics, animations, sounds, images, illustrations, layout, etc.), as well as all related Intellectual Property Rights and copyright.  The Site and all its constituent parts are protected by the laws on Intellectual Property and Copyright.

The user is only authorized to view, download and print forms without prior request.

Reproduction of any type of content on the Site is authorised subject to express mention of the source. Under no circumstances can these types of content be sold or rented for consideration.

Any modification, transformation or adaptation, in whole or in part, of the content is strictly prohibited.

Users who reproduce content from the portal undertake not to use it in a manner contrary to human dignity and respect for the individual.

The rights implicitly or explicitly granted to you above constitute an authorisation to use and under no circumstances a transfer of rights, property or other relating to this Site.

You may be held liable for any breach of the foregoing.


7. GENERAL LIMITATIONS OF LIABILITY

The Consortium ensures maximum availability of the Site. However, it may not be held liable in the event of temporary, partial or total unavailability of the Site.

The Consortium makes every reasonable effort to ensure the accuracy of the information contained on the Site and possibly put online via other communication channels. However, it may not be held liable for inaccuracies, gaps or errors in the information made available on this site, for failure to update information or forms, or for system manipulation or encoding errors. The aim is to provide accurate and up-to-date information, but the Consortium cannot claim to avoid all risk of intellectual and/or material error. The information on the Site does not constitute a commitment on our part and may not be exhaustive.

The information that appears on this site relates to the Consortium's missions and activities. It is not intended to take account of the personal or particular circumstances of the User. It cannot therefore be considered as individual, professional or legal advice for the User. If the User wishes to receive advice, he/she is invited to consult the Consortium via the contact form provided.


8. DATA PROTECTION

Information is detailed in the Privacy policy


9. UNILATERAL RIGHT OF MODIFICATION

The Consortium reserves the right to modify unilaterally, at any time, all or part of the Website in particular in case of technical, legal or case-law developments or to implement of new functionalities. Luxinnovation may, for example, modify the visuals, graphic charts and other elements and/or contents at its sole discretion.

The Consortium shall not be held liable for any direct or indirect damage resulting from such modifications. Users are invited to consult these GCU regularly and to comply with them.


10. CONTENT GENERATED BY ARTIFICIAL INTELLIGENCE

Certain portions of the content on the Luxinnovation Internet Platform (including, but not limited to texts, images, translations, and any other media) may have been generated, translated, or enhanced using artificial intelligence technologies. In accordance with Regulation (EU) 2024/1689 on Artificial Intelligence (AI Act), Luxinnovation is committed to ensuring an appropriate level of transparency regarding the use of this content. While its quality, relevance, and accuracy remain a fundamental editorial requirement for Luxinnovation, we cannot guarantee its completeness or complete reliability. Also, although not required by the European AI Act, this content generated using artificial intelligence published on its Platform and published on the Platform will be labelled and accompanied by an explanatory statement regarding its source.

In the case of these specific contents, the Visitor to the Platform is invited to exercise their own judgment. Their use remains entirely at their own risk. Luxinnovation cannot be held responsible for this use or its consequences. If they wish, the Visitor can report any content they deem inappropriate or erroneous to the following address: web@luxinnovation.lu.


11. MISCELLANEOUS

Entirety. These Terms and Conditions contain and set forth the entire intention of the Parties and supersede any other agreement, understanding or arrangement, whether oral or written, relating to or in connection with the subject matter of the Agreement.

Severability. If one of the conditions of these Terms and Conditions becomes invalid, the validity of the other conditions will not be affected. The User agrees that in the event of the cancellation of any of the conditions, he/she remains subject to the application of all the others.


12. GOVERNING LAW AND JURISDICTION

Wherever the Site is used and/or consulted, these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Grand Duchy of Luxembourg.

The Parties irrevocably agree that any dispute arising out of or in connection with the Terms and Conditions shall be submitted exclusively to the courts of the City of Luxembourg, Grand Duchy of Luxembourg.
